“I tell prospective clients they should assemble a first-rate team of experts to support them during the acquisition process.  Then, while the broker is canvassing the global market for an aircraft that best meets the client’s preferences and mission profile, the client should confer with legal and accounting advisors to devise an ownership structure and a tax plan that best complements the purchase.  A clear understanding of these elements is vital to aircraft ownership and to the financial viability of the acquisition.  Without a well-defined ownership structure and tax plan in place, the client quite literally does not have enough information to move forward successfully with the aircraft selection.”

“After leaving the 1984 Los Angeles Olympic Organizing Committee, I became vice president and general counsel of American Golf Corporation.  In the eight years that followed, I represented American Golf in the acquisition of more than 200 country clubs and golf courses.  The founder and owner of American Golf was an ex-U.S. Navy pilot and a passionate collector of Warbirds and other vintage aircraft.  I got involved in aircraft acquisitions and sales on his behalf, and I loved working with airplanes and the nature of the transactions.  So, I switched gears, became a full-time aviation lawyer, and I’ve been doing it now for over 25 years.”

Biography

Stephen Hofer is president of the Aerlex Law Group in Santa Monica, California, which he founded in 2005.  He has been practicing law for 37 years.  Mr. Hofer has managed hundreds of domestic and international aviation transactions on six continents, counseling clients on aircraft acquisition and operation, tax strategy, ownership structure, insurance coverage, fractional ownership and other private flight options, aircraft financing, charter and management agreements, FAA and DOT regulatory and compliance issues, crisis management and aircraft import and export.  His clients include high-net-worth individuals, prominent figures in entertainment, music and sports, corporate flight departments, and charter and management companies.

Prior to establishing Aerlex, Mr. Hofer was a partner and chair of the corporate and transactional department at Bailey & Partners in Santa Monica.   He started his legal career at Gibson, Dunn & Crutcher, then the fifth-largest law firm in the world, and worked for the 1984 Los Angeles Olympic Organizing Committee before joining American Golf Corporation.  He is a graduate of Northwestern University Law School in Chicago and won the school’s Lowden-Wigmore Award for outstanding law review article.
